FMCSA Hours of Service Waiver Winter Storm Fern

In addition to the 5-day, statewide hours-of-service waiver issued yesterday by the Texas Department of Public Safety (DPS), the Federal Motor Carrier Safety Administration (FMCSA) has issued a separate 14-day emergency declaration this afternoon covering 40 states, including Texas.
This federal Emergency Declaration provides relief from federal hours-of-service requirements for the transportation of essential commodities, including propane, to customers in affected states impacted by severe winter storms and extremely low temperatures.
The states covered under this declaration include: Alabama, Arkansas, Colorado, Connecticut, Delaware, District of Columbia, Florida, Georgia, Illinois, Indiana, Iowa, Kansas, Kentucky, Louisiana, Maryland, Massachusetts, Michigan, Mississippi, Minnesota, Missouri, Montana, Nebraska, New Hampshire, New Jersey, New York, North Carolina, North Dakota, Ohio, Oklahoma, Pennsylvania, Rhode Island, South Carolina, South Dakota, Tennessee, Texas, Vermont, Virginia, West Virginia, Wisconsin, and Wyoming.
Pursuant to 49 CFR § 390.23, the Emergency Declaration is effective immediately and will remain in place until the end of the emergency (as defined in 49 CFR § 390.5T) or until 11:59 p.m. (ET) on February 6, 2026—whichever occurs first.
