Legislative Update


  • Committee Chair provided an overview of top bills as the 89th Legislative Session nears adjournment on June 2


Legal & Regulatory Affairs


  • Houston Lawsuit: City of Houston is challenging the constitutionality of TPGA-supported law

  • Case returns to court in July

  • Attorney General Ken Paxton may join to defend the law

  • TPGA legal counsel remains confident in a favorable outcome


Temperature Compensation for Dispensers


  • NIST mandates temperature compensation for all new LP-Gas dispensers by 2026; existing dispensers by 2030

  • Joint NPGA/NIST proposal seeks to extend retroactivity deadline to 2034

  • Applies to dispensers rated at 20 GPM or less

  • Only electronic compensation systems qualify

  • Estimated cost: $3,000–$4,000 per dispenser


Texas Department of Agriculture Resolution


  • Commissioner Sid Miller verbally approved continued fixed-price sales for 20 lb propane cylinders

  • TPGA is seeking formal written confirmation


FMCSA English Proficiency Enforcement


  • Effective immediately

  • Drivers must be able to:

    • Converse with the public

    • Understand signs and signals

    • Respond to inquiries

    • Complete reports

  • Includes interviews and highway sign recognition tests

  • Drivers failing assessments will be placed out of service

To provide a clearinghouse for issues that affect the propane industry and generate a consensus to represent propane marketers before other businesses, governmental and regulatory bodies.
