Tier II Reports are due by March 1st

Texas propane retailers and bulk storage facilities are reminded to submit their Texas Tier II hazardous chemical inventory reports each year if propane is stored above federal reporting thresholds. Required under the Emergency Planning and Community Right-to-Know Act (EPCRA) and administered in Texas by the Texas Commission on Environmental Quality (TCEQ), Tier II reporting applies to facilities that meet or exceed the reporting trigger at any time during the calendar year.


In Texas, Tier II reports are due by March 1 each year for the preceding calendar year. Facilities should review storage capacities and the maximum amount of propane on-site at any time during the reporting year to determine if reporting is required.


Key Considerations:

• Reporting Threshold: Propane (LP-Gas) triggers reporting at 2,358 gallons (10,000 pounds) present at any one time.

• Who Must File: Any facility storing reportable quantities, including bulk plants and certain retail locations.

• Where to Submit: Reports must be filed with the Texas TCEQ Tier II Reporting Program, the appropriate Local Emergency Planning Committee (LEPC), and the local fire department.

• Agricultural Exemption: Under EPCRA, farms using propane in routine agricultural operations (such as crop drying) on their own farms may be exempt from Tier II reporting.
