FMCSA Rolls Out New Process for Challenging Inspection & Crash Records
The Federal Motor Carrier Safety Administration (FMCSA) has implemented significant changes to its DataQs system, giving motor carriers and commercial drivers a more transparent and structured process for disputing inaccurate federal safety records.
Effective September 18, 2026, the updated system introduces new review deadlines, independent oversight, and website improvements designed to make it easier to challenge incorrect or incomplete crash and roadside inspection information.
What's Changed?
One of the most notable improvements is a three-level review process intended to provide greater consistency and impartiality when evaluating Requests for Data Review (RDRs).
· Initial Review: Agencies must complete their first assessment within 21 days.
· Reconsideration: If disputed, a second review must be completed within 21 days by independent experts who were not involved in the original decision.
· Final Review: A senior official or independent panel must issue a final determination within 45 days.
States must also accept challenges submitted within 3 years of an inspection or 5 years of a crash. Reviewing agencies are now required to provide clearer explanations of their decisions, particularly when requests for corrections are denied.
Improved Online Experience
FMCSA has also redesigned portions of the DataQs website to simplify submissions and improve communication. Users can more easily monitor the status of a dispute, review correspondence, submit additional information, and track requests through each stage of the process.
Motor carriers and drivers can submit requests and access the updated system at dataqs.fmcsa.dot.gov
