Pursuant to 49 CFR Part 390.23 and Chapter 644 of the Texas Transportation Code, the Texas Department of Public Safety has granted a 5-day emergency declaration in response to the State of Texas's severe weather conditions. Declaration of this emergency provides relief from Title 49, CFR, Part 395.3 (Hours of Service)
of the Federal Motor Carrier Safety Regulations for motor carriers in Texas, providing direct assistance to propane delivery to storage facilities and homes in the State of Texas. The emergency declaration will take effect at 12:01 a.m., February 10, 2021, and will remain in effect for the duration of the emergency (as defined in Title 49, CFR, Part 390.5) or for 5 days, ending at 11:59 p.m., February 15, 2021, whichever is less. Although the waiver is initially granted for 5 days, the DPS said it would consider an extension if this weather event persists. Please find a SIGNED copy of the waiver.
