Texas Department of Public Safety Grants Hours-of-Service Waiver for Propane

TPGA is still assessing the Governor’s Disaster Proclamation and details on which areas it will cover.
In the meantime, the Texas Department of Public Safety (DPS) has declared an emergency, allowing certain exemptions from 49 CFR Parts 390–399 in response to TPGA’s request related to extreme cold and anticipated inclement weather.
This emergency declaration provides relief from Title 49, CFR, Part 395.3 hours-of-service restrictions outlined in the Federal Motor Carrier Safety Regulations for motor carriers providing direct assistance to the delivery of propane, fuel, and groceries.
Consistent with Title 49, CFR, Part 390.23, the emergency declaration took effect at 12:01 a.m. on January 22, 2026, (as of midnight last night) and will remain in effect for the duration of the emergency (as defined in Title 49, CFR, Part 390.5) or for five (5) days, ending at 11:59 p.m. on January 26, 2026, whichever is less.
Download, print, and place the waiver in all propane delivery vehicles to comply with the exemption requirements.
